Preamble

The current terms and conditions of sale (the “general terms and conditions”) will constitute the entire agreement between My Butterfly Life and any legal person or business (“You”) who wishes to consult the website or make a purchase. The general terms and conditions solely govern your relationship with My Butterfly Life. My Butterfly Life reserves the right to change the terms and conditions at any time. They will then apply to their online placement.

Products

The products governed by the current general terms and conditions are those displayed on the Website and are listed as sold and shipped by My Butterfly Life (the “Products”). They are offered within the limits of available stocks. The essential properties of the products are described and presented with the greatest possible accuracy.

Price

The prices of the products are stated in euros, with all taxes included. They account for the VAT and any applicable reductions on the order day. The prices of the products are based on delivery costs (port, packaging and confectionery of the bags according to the applicable quantities). The size of the delivery fee will be specified before validating the order. If one or more taxes or contributions, especially environmental, are created or changed as a result, this change may be reflected in the selling price of the products available on the Website and on the various sales support. However, a price cannot be changed once your order has been validated. Nevertheless, in case of price error (price obviously exorbitant in relation to the real value of the product), the valid order can be cancelled by My Butterfly Life. This measure is unusual.

Order

Prior Identification

To place an order, you must identify yourself with your email address or username and password. For every first order, you need to create an account.

Registration and validation of the order

You have the option of placing your order online: – from the online store; Once your coupon is validated, select your address and delivery method and validate your payment method. This last step formalizes the sales contract with My Butterfly Life. All orders are subject to acceptance of prices and descriptions of available products for sale. My Butterfly Life accepts receipt of your order after validation by sending you an email, in which you will find a link to the current general terms and conditions. In some cases, especially for default payment, incorrect address, or any other issue related to your account, My Butterfly Life reserves the right to block your order until the issue is resolved. In the event that an ordered product is not available, you will be notified via email. The cancellation of the order for this product and its possible refund (only the products available at the time of the order can carry out the item of a withdrawal in the event of opposition to the various products) will then be completed, the rest of the order remaining firm and final. Payment Modalities

You can purchase your order with VISA, Master Card, American Express, Bancontact, Multibanco or via PayPal.

Shipping

Shipping to Europe

All purchased products on the website are shipped to the address specified by the customer at the time of order, within a period of 3 to 7 working days (counting from the shipping).

Delivery fees are clearly specified on the website before proceeding with the order.

Donation to Debra Spain

The sale of these products aims to collect donations for the association Debra Spain.
For this purpose, 25% of each purchase will be transferred to the account of the association Debra Spain.

This project has been accepted and an agreement has been signed between My Butterfly Life and the association.
Both My Butterfly Life and Debra Spain are transparent about the process of donations.

Fiscally, the purchase of one of our products does not give the right to tax deduction for your company.
If you wish to make a donation with deductions, we invite you to make it directly to the account of the organization of your choice.

Refund Of Products

Exercise of right of Withdrawal

The client has a right of withdrawal which can be exercised within a period of four calendar days following the date of receipt or withdrawal of the order. It suffices to send a complaint by email: hello@mybutterfly.life

The client who exercises his right of withdrawal must return the articles received within a period of fourteen (14) days after notification of his withdrawal. My Butterfly Life then proceeds with the refund of the amount corresponding to articles purchased within the four-day delay following receipt of the parcel returned in full as well as in its original condition.

My Butterfly Life has the right to deduct an amount equal to the loss of value of the product compared to its original value, provided that this loss of value results from the fact that you have manipulated the product more than it is necessary to ensure its characteristics or functions. Return fees are at the customer’s charge.

My Butterfly Life accepts receipt of your withdrawal, by email.

Particular Case of a Non-Compliant Product

My Butterfly Life advises you to check the Product at the time of delivery and in the event that the Delivered Product will be non-compliant (Mistaken Product, Defective Product, damaged or incomplete), to notify My Butterfly Life no later than three (3) days following this delivery.

In which case, the rules referred to in Article 8.1 on the legal guarantees apply. Thus, the non-compliant delivered Product will only able to be subject, at least initially, to a replacement or repair. However, if the received product does not suit you, you will be able to exercise, if applicable, your right of withdrawal within the remaining period.

For non-compliant Products reported within three (3) days after delivery, My Butterfly Life will nevertheless allow you to exercise your right of withdrawal and obtain the refund of the Product in the application of the rules of Article 7.1, without passing by repair or replacement, as provided by the legal guarantee of conformity.

Litigation

At the European level, the European Commission has at its disposal an Online Dispute Resolution platform.

Evidence

The entry of the credit card number and the validation of the order will require proof of the integrity of the order in accordance with Article 1366 of the Civil Code and will require enforceability of amounts committed by the seizure of Products appearing on the purchase order. This validation is subject to signature and express acceptance of all operations performed on the Website. However, in case of fraudulent use of your bank card, you are invited, as soon as this use is noticed, to contact the Customer Service: hello@mybutterfly.life

The computerized records, preserved in the computer systems of My Butterfly Life under reasonable security conditions, will be considered as proof of communications, orders and payments occurring between You and My Butterfly Life.

The filing of orders and invoices has been carried out on reliable and durable support in a manner corresponding to a faithful and durable copy in accordance with Article 1379 of the Civil Code.

Responsibility

My Butterfly Life has a performance obligation for all stages of ordering as well as for the stages subsequent to the conclusion of the contract. Thus, My Butterfly Life is committed to describing the Products Sold on the Website. In return, My Butterfly Life’s responsibility will not be committed to any inconveniences or damages inherent in the use of the Internet network, in particular a service outage, an external intrusion or the presence of IT viruses.

Applicable law and legal competence

The General Conditions are subject to European law. The competent court in case of litigation will be the one of the place of residence of the defendant or, at the choice of the claimant, the place of effective delivery of the Product. The Website complies with European legislation, and in any case, My Butterfly Life does not guarantee compliance with local legislation which will be applicable to you, provided you access the Website from other countries.
